Kapsch TrafficCom: Response to the recent Monopolies Commission decision concerning the Slovakian toll system tender

"We were surprised by the Slovakian Monopolies Commission's ruling to dismiss our objection against the decision made within the toll system tender. The fact remains that the alleged technical "deficiencies" within the tender proposal asserted by the contracting party are untenable, both from a technical as well as from an objective point of view", explains Erwin Toplak, Member of the Board of Directors at Kapsch TrafficCom. "We have not yet received a statement on the Monopolies Commission's reasons, which is why we are currently unable to offer a detailed response to the dismissal of our objection. However, Kapsch TrafficCom will continue to exploit all available legal means to proceed against this decision". Moreover, Kapsch TrafficCom has already lodged a further objection at the Monopolies Commission due to discrimination during the tender procedure. This refers to the public contracting party’s assessment of technical conformity and statement regarding tender proposals.

"We welcome the Monopolies Commission's decision to allow our proposal for preliminary injunction. The authorities thus enjoin the contracting party from taking further steps within the toll system tender until a decision has been reached regarding the objection", Erwin Toplak explains.
